Terms of Use

Acceptance of These Terms.

These Terms of Use are an agreement between you and Some Luck Productions LLC, a Wyoming limited liability company ("Some Luck Productions"). They cover:

• the website SomeLuckMarketing.com (the "Site"); and
• the AI apps, plugins, and agent skills published by Some Luck Productions, including ChatGPT apps, Claude plugins and skills, and open-source repositories under github.com/andrewluxem (together, the "Apps").

The Site and the Apps together are the "Services." By using the Services, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Services.

Consulting engagements with Some Luck Marketing are governed by a separate written agreement, not by these Terms.

Eligibility.

You must be at least 13 years old, and at least the minimum age required by the host platform you use the Apps through, to use the Services. If you use the Services on behalf of an organization, you confirm that you have authority to accept these Terms for it.

Host Platforms.

The Apps run inside third-party platforms such as OpenAI ChatGPT and Anthropic Claude. Your use of those platforms is governed by their own terms and policies. Some Luck Productions does not control those platforms and is not responsible for their availability, behavior, or content.

No Warranties.

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some Luck Productions does not promise that the Services will be uninterrupted, error free, or secure.

AI Outputs Are Not Professional Advice.

The Apps use AI and can produce outputs that are inaccurate, incomplete, or out of date. Check any output before you rely on it. Outputs are not legal, financial, tax, medical, or other professional advice, and using the Services does not create a professional relationship of any kind. For decisions in those areas, consult a qualified professional.

Acceptable Use.

You agree not to:

• use the Services for anything unlawful, or to help anyone else break the law;
• abuse, overload, or interfere with the Services, including by sending excessive automated requests;
• try to gain unauthorized access to the Services or the systems behind them;
• reverse engineer, decompile, or extract the source code of hosted services, except where the law expressly allows it or where the code is released under an open-source license;
• use the Services to harass, defraud, or harm others, or to create content that infringes someone else's rights; or
• break the terms or usage policies of the host platform you use the Apps through.

Open-Source Repositories.

Code published in open-source repositories under github.com/andrewluxem is governed by the LICENSE file in each repository. If a repository's license conflicts with these Terms, the license controls for that code.

Intellectual Property.

Except for open-source code covered by its own license, the Services, including their content, design, names, and logos, belong to Some Luck Productions or its licensors and are protected by intellectual property law. These Terms do not give you any right to use them beyond using the Services as intended.

You keep any rights you have in the inputs you provide. As between you and Some Luck Productions, you may use the outputs the Apps generate for you, subject to these Terms and the host platform's terms.

Limitation of Liability.

To the fullest extent the law allows, Some Luck Productions and its members, managers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to the Services, even if advised that such damages were possible.

To the fullest extent the law allows, the total liability of Some Luck Productions for any claim related to the Services is limited to the greater of the amount you paid Some Luck Productions for the Services in the 12 months before the claim, or 100 US dollars.

Indemnification.

You agree to defend, indemnify, and hold harmless Some Luck Productions and its members, managers, and contractors from any claims, losses, and expenses (including reasonable attorney fees) arising from your use of the Services, your content, or your breach of these Terms.

Governing Law.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute related to these Terms or the Services will be brought in the state or federal courts located in Laramie County, Wyoming, and you consent to their jurisdiction.

Termination.

Some Luck Productions may suspend or end your access to any of the Services at any time, for any reason, including a breach of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination, including No Warranties, Limitation of Liability, Indemnification, and Governing Law, will survive.

Changes to These Terms.

These Terms may be updated from time to time. The effective date at the top of this page shows when they last changed. Continuing to use the Services after a change means you accept the updated Terms.
